Please read this waiver carefully before checking the agreement box below. This waiver applies to you and to any guests, including minors, listed in this form.

1. Description of Activity. The Edible Plant & Herb Walk is a guided outdoor walk led by Nourishment Works (“Company,” “we,” “us”) at Seaview Trailhead, Tilden Regional Park, lasting approximately two hours. The walk includes identification and discussion of edible and medicinal plants, and participants may taste or sample foraged plant material as part of the experience.

2. Assumption of Risk. I understand that participating in this activity involves risks that cannot always be eliminated, including injury from walking on uneven, hilly, or unmaintained trail terrain; exposure to weather, insects, ticks, poison oak, and wildlife; and illness, allergic reaction, or adverse physical reaction from tasting, touching, or ingesting wild plant material, including reactions caused by misidentification, individual sensitivity or allergy, or contamination. Nourishment Works and its guides are not physicians, and nothing shared during this walk is medical advice or a substitute for consulting a qualified healthcare provider, particularly regarding food allergies or sensitivities. I am solely responsible for deciding whether to taste or ingest any plant offered during the walk, and I do so voluntarily and at my own risk.

3. Release of Liability. In consideration of being permitted to participate, I, on behalf of myself and any guests listed in this form, release and forever discharge Nourishment Works, its owner, employees, guides, and agents (“Released Parties”) from any and all claims, demands, or causes of action arising out of ordinary negligence in connection with my participation in this activity. This release does not apply to, and does not waive any claim for, gross negligence, recklessness, or intentional misconduct by the Released Parties, as California law does not permit waiving liability for those.

4. Indemnification. I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost arising from my participation, to the extent permitted by law.

5. Medical Treatment. In the event of illness or injury, I authorize Nourishment Works to arrange for emergency medical treatment on my behalf (or on behalf of any minor guest listed) if I am unable to do so myself, and I agree to be financially responsible for any costs of such treatment.

6. Physical Condition. I confirm that I am physically able to participate in a two-hour walk on uneven and hilly terrain, and that I have no medical condition that would make participation unsafe. If I am uncertain, I will consult a physician before participating.

7. Minors. If I am registering any guest under 18, I represent that I am their parent or legal guardian, and I agree to this entire waiver on their behalf, including the release, assumption of risk, and indemnification provisions above.

8. Photo and Media Release. I grant Nourishment Works permission to photograph or video me (and any minor guests listed) during this walk and to use those images or videos in marketing materials, social media, and its website. If I do not want to be photographed, I will notify my guide at the start of the walk.

9. General. This agreement is governed by the laws of the State of California. If any provision of this agreement is found unenforceable, the remaining provisions will remain in full effect. This is the entire agreement between the parties regarding this activity.
